Maxim Loboda, a CDU man from Eimsbüttel who is otherwise known as a committed politician, is facing serious allegations. On the fresh morning of July 30th, around 2:40 a.m., he was stopped by the police in Rotherbaum after his erratic driving drew attention. The officers immediately noticed the distinct smell of alcohol on his breath, but Loboda was uncooperative and refused a voluntary breath test. Instead, a blood test was ordered.
When it comes to the consequences of such actions, it quickly becomes clear that drunk driving is taken extremely seriously in Germany. According to Section 316 of the Criminal Code, a driver is considered unfit to drive with a blood alcohol content of 0.5 per mille, and is even considered punishable if the blood alcohol content is 1.1 per mille. Penalties range from fines to driving license suspensions to imprisonment, especially for repeat offenders. Loboda must not have missed the fact that proof must be provided. Mere suspicion alone is not enough for a conviction; clear evidence is required, such as: B. direct observation by police officers or witness statements about alcohol consumption and driving.
Why didn't Loboda stop? This remains unclear as he apparently slightly injured two policewomen while trying to escape. Loboda himself defends himself against the accusations of having used violence or of having fled. Nevertheless, he has already submitted his written apology and plans to speak seriously about the situation at the next group meeting. This was also confirmed by CDU parliamentary group leader Rüdiger Kuhn, who is already publicly putting pressure on Loboda to give up his mandate in the district assembly.
Loboda himself is not only a face of the CDU in Eimsbüttel, but also deputy state executive of the Hamburg Young Union. It remains to be seen whether these incidents will lead to a definitive end to his political career. The uncertainty about the possibility of further cooperation or even a possible exclusion from the group is buzzing in the air.
The basic possible penalties:

Ultimately, each of us should know what alternatives there are to driving and how important our own alcohol tolerance is.
In the Loboda case, it should be noted that he now has to face a serious examination of his own actions. The public and political bodies will be watching closely to see how he handles this delicate situation. If the suspicion deepens and he is possibly even convicted, it could not only mean the end of his political career, but also his personal integrity. A difficult situation for a man who was once very popular and now has to contend with a huge shadow.
