Convertible driver after accident with 13-year-old: public prosecutor's office appeals

A serious traffic accident in which a 13-year-old boy was seriously injured in Prora on Rügen has legal consequences that are now entering the next round. A 47-year-old entrepreneur was convicted of negligent bodily harm and hit-and-run. At the Bergen district court a fine of 12,000 euros and a driving license suspension for one and a half years were imposed, reports Baltic Sea newspaper.

The incident occurred during a school trip on August 14 when the boy was away from his classmates. Eyewitness reported that the defendant hit the child with a deliberate steering movement, but the court could not determine any intent. The 47-year-old denies intentionally hitting the boy and the public prosecutor believes the sentence is not sufficient. She had originally asked for a two-year suspended prison sentence and has now filed an appeal to achieve more against the entrepreneur.

Appeal and retrial

The appeal was brought to the Stralsund Regional Court, where the case is now being reheard. Judges have the option to confirm, reduce or increase the sentence. An exact date for the trial has not yet been set, and it also remains unclear whether witnesses will have to testify again, as they did NDR reported.

During the investigation it was determined that the boy had suffered a traumatic brain injury, abdominal trauma and multiple wounds. The incident caused an uproar and a week-long search for the driver and the vehicle, which was ultimately found on the defendant's premises. The charge also provides for dangerous interference with road traffic and grievous bodily harm, which has additional criminal relevance.

Legal consequences of negligent bodily harm

Negligent bodily harm is considered a serious traffic charge. According to Section 229 of the Criminal Code, it is punished with a prison sentence of up to three years or a fine, which shows what dimensions this procedure could take. The penalties can also be imposed in rear-end collisions in which bystanders are injured. Even without a report from the accident victims, the person responsible can be prosecuted and points can be entered in Flensburg, like the information from Catalog of fines suggest.

The public prosecutor also doubts the credibility of the witnesses and a technical report that could not prove any intended action. The entire process continues to receive public attention as the legal consequences have far-reaching implications for everyone involved.
