Today, the developments in the murder of eight-year-old Fabian from Güstrow have come into focus again. Attorney Andreas Ohm has submitted a writ of habeas corpus for his client, a woman suspected of the crime. This was heard by the investigating judge at the Rostock district court. What is special about this case is the lawyer's argument: According to him, the reasons for detention are based solely on circumstantial evidence - no solid evidence can be found in the file.

The murder weapon has not yet been found and the client has not commented on the allegations after denying the crime as a witness. On November 6, the woman was arrested on strong suspicion of murder after her car, an orange Ford Ranger, was seized during a raid. The search for further evidence and clues about her vehicle continues and police have already launched a witness appeal to find other people who saw the car on October 10th. That day little Fabian disappeared, whose body was found four days later in a pond near Klein Upahl.

Hope for release

Attorney Ohm is optimistic that the prospect of his client's dismissal is realistic. Nevertheless, he points out that courts often act cautiously when dealing with serious allegations. If the application is rejected, he will examine the possibility of an appeal. The public defender works all the more intensively into the extensive files and tries to question the evidence on which the public prosecutor's office relies. Ohm describes this evidence as being taken out of context and does not believe it is sufficient to convict.

The situation for Fabian's mother is also not easy. In an interview, she expressed her frustration at the lack of progress in the investigation and feels abandoned by the authorities. The investigation into the gruesome crime is still ongoing and the public prosecutor's office has not named any other suspects. It will still take a few days for the final decision on the application for habeas corpus, as the hearing must take place within two weeks.
