Bühler and his colleagues criticize this draft as oversized and plead for a new, impartial planning process in which all votes must be heard.

In May 2024, the Hamburg Higher Regional Court rejected an urgent application from the initiative and the Prellbock e.V. association, which wanted to protest against the new building. The Higher Administrative Court (OVG) will now negotiate Prellbock's lawsuit against the planning approval decision on Tuesday. Bühler is convinced that the arguments of the initiative are strong enough to prevent the bridge. Nevertheless, the court assesses the prospects of success of the lawsuit as low.
