Court stops e-scooter tours through Bad Dürkheim's vineyards!

The discussion about the use of e-scooters in Germany is gaining momentum. A recent court ruling is causing a lot of conversation in Bad Dürkheim. The city had banned an entrepreneur from organizing guided e-scooter tours through the picturesque vineyards. The Neustadt Administrative Court has confirmed this prohibition in a groundbreaking decision and points out that leisure activities are not permitted without appropriate approval. According to the court decision, the roads marked with traffic sign 250 are open exclusively to agricultural traffic, which directly canceled the entrepreneur's plans.

The entrepreneur argued that his throttled e-scooters, which reach a maximum of 6 km/h, could legally be classified as “ambulance elevators” and could therefore drive anywhere where pedestrians are allowed. However, the court rejected this argument. It made it clear that the paths are primarily intended for agriculture and commercial use would require express permission from the city. Winemakers from the region had already expressed concerns and pointed out the increased risk of accidents caused by e-scooters. ADAC states that e-scooter use in the commercial sector is strictly regulated in order to avoid accidents.

Regulation of the use of e-scooters

E-scooters are now popular in many German cities as a means of transport for short distances, but there are numerous problems. Sidewalks are blocked, accidents are increasing, and citizen unease is growing in both urban and rural regions. Therefore, the court made it clear that municipalities can restrict the use of e-scooters to ensure public safety and the use of public facilities. A violation can be punished with fines, and points in Flensburg are also possible.

The current regulations state that e-scooters are only allowed to travel on roads and cycle paths at a speed of up to 20 km/h. Only use at walking speed is permitted on sidewalks if this has been approved by additional signs. There is no legal requirement to wear a helmet, but it is strongly recommended. In addition, e-scooters require liability insurance, which must be proven by an insurance sticker, like the current one reporting shows.

In summary, it should be noted that e-scooters in the recreational sector require clear rules and permits. The ruling by the administrative court in Bad Dürkheim increases awareness of the legal framework and ensures that safety on the paths has top priority. While the discussion about the legal basis continues, it remains to be seen whether new regulations will offer more space for e-scooter tours in the coming years or whether the trend is towards stricter controls.
