Legal basis of retirement
But what exactly happens when a state councilor is temporarily retired? According to the regulations that differ between different levels of the public service, this transfer is an administrative act. Political officials can only be placed on temporary retirement if they are appointed for life, as set out in paragraph 54 BBG. The decision on the transfer comes from the responsible federal minister, while the application is submitted to the Federal President. For the first three years of temporary retirement, civil servants receive a maximum of 71.75% of their pensionable salary, which may decrease thereafter. A common misconception is that all civil servants can expect the same salary for the rest of their lives, but this is not true. Paragraph 56 BBG even allows the transfer order to be withdrawn until retirement begins.
