On August 14, 2025, a groundbreaking decision by the Lower Saxony State Court was announced in Bückeburg: The CDU's lawsuit against the second supplementary budget for 2023 was dismissed. This decision did not come as a surprise, as the dispute over the budget law has caused a stir in recent months.

The CDU initiated legal action in February 2024 and demanded the invalidity of the budget laws in question. According to the CDU, they felt ignored because the red-green coalition had significantly shortened the consultation time for the supplementary budget. This meant that the opposition, consisting of 46 CDU MPs, only had one and a half days to a maximum of a week to examine the additional expenditure of around 15.5 million euros that had been brought to the committee at short notice.

A judgment with consequences

In the supplementary budget, which was passed in May 2023, additional expenditure totaling 776 million euros is planned. The majority of these funds should benefit refugees and local communities. However, the State Court found that there were no procedural deficiencies; The vote in parliament was crucial.

The SPD sees the verdict as a “victory across the board” and sees its position on budget preparation confirmed. The Greens also feel strengthened by the decision and have announced that they will improve their cooperation with the opposition in the future. It should be noted that the country benefits from a high fine: the municipalities are to receive a total of 640 million euros, which could be beneficial for the local infrastructure.
