There is currently a difficult situation for the residents of a high-rise complex in Göttingen: the heating is not working. This has led to lawyer Sven Adam representing several tenants who are now taking legal action. He is calling for the building to be declared uninhabitable and is suing the administrative court to get the city of Göttingen to place the affected families in emergency accommodation, including a single 36-year-old with her four children who lives in a small two-room apartment on the fifth floor. The heating, which has been turned off since the end of the heating season in March, may be intentionally not being used to save costs, according to Adam.
The property management has not yet responded to inquiries, and the city of Göttingen has already initiated inspections in the high-rise building because, in addition to the heating, there are structural defects and vermin infestation. The fact that the majority owner of the residential complex is insolvent makes the situation even more difficult. Adam has therefore asked the city to place the building under receivership. Many of the residents receive social benefits, while the rental prices are particularly high compared to the overall situation in Göttingen.
City administration under pressure
The city of Göttingen emphasizes that the well-being of its residents is always kept in mind. A city spokesman explains that an agreement has already been made to supply heat until the end of the heating season. However, declaring uninhabitability involves high hurdles and can only be made for individual apartments. The city has not yet been able to confirm media reports about outstanding rent payments from benefit recipients, but suspects that the property management wants to manipulate public perception.
Mayor Petra Broistedt sharply criticizes the actions of the owners and the property management. It remains to be seen how the legal disputes will turn out and whether the city will take the necessary steps to guarantee the residents decent housing.
In the midst of these disputes, it is important that the city focuses not only on the legal aspects, but also on the human side of the crisis. The pressure is growing and the hope that a solution will soon be found for the residents remains.
