In a current case that is of interest to both the judiciary and the public, the Celle Higher Regional Court has decided to review the conditions for a suspect in the Madeleine McCann case. 48-year-old Christian B. was recently released from prison, where he had to serve a multi-year sentence for serious rape. This decision follows a complaint from his lawyer, Friedrich Fülscher, who pointed out the numerous instructions that were imposed on him.
The focus of the judicial review was on several instructions, including the obligation to seek a permanent residence in Germany. The Hildesheim Regional Court had ordered this, but the Higher Regional Court decided that this instruction had to be made more specific. This decision was seen as a partial success for Christian B., as leaving Germany is no longer ruled out. “It is now possible for Christian B. to leave the country as soon as possible,” explained Fülscher.
Background on Christian B. and the Maddie McCann investigation
The investigation against Christian B. has been ongoing since 2020. He is suspected of being involved in the disappearance of then three-year-old Maddie McCann, who disappeared from a holiday apartment in Portugal on May 3, 2007 while her parents were having dinner in a nearby restaurant. Despite these serious allegations, there are currently no charges against him. Official information describes Christian B. as “highly dangerous,” raising concerns about his predisposition to further sexual offenses.
Another important element in this case is the requirement to wear an electronic ankle bracelet to monitor Christian B.'s whereabouts. This measure is intended to ensure that the authorities are informed about his movements at all times. After he is released from prison in mid-September 2025, this regulation will apply for five years.
